Terms of Service

These Terms of Service ("Terms") govern your use of the KhayaPay mobile application and related services (the "Service"), provided by Axiomatics Technologies (Pty) Ltd (registration number 2026/118542/07), trading as KhayaPay ("KhayaPay", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What KhayaPay is
KhayaPay is a tool that helps South African households manage payroll and employment compliance for domestic workers — calculating pay, producing payslips and statutory documents, tracking leave, and delivering documents and notices (including via WhatsApp). KhayaPay does not provide legal, tax or accounting advice, and it does not file returns or submit information to SARS, the UIF, the Compensation Fund or any other government body on your behalf. The app helps you prepare information; you remain responsible for reviewing it and for any submissions you make.
2. Eligibility and your account
You must be at least 18 years old and able to enter into a binding agreement. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly if you suspect unauthorised access.
3. Your responsibilities as an employer
- You are responsible for the accuracy of the information you enter and for meeting your own legal obligations as an employer, including under the Basic Conditions of Employment Act, the National Minimum Wage Act, UIF, COIDA and PAYE requirements.
- You confirm that you are entitled and authorised to process the personal information of every worker you add, and that you have obtained each worker's consent to processing in KhayaPay and to receiving documents and notices via WhatsApp.
- You are responsible for reviewing all calculations and documents before you rely on, issue or submit them.
4. Acceptable use
You agree not to misuse the Service, including by: using it unlawfully or to harass or harm any person; sending spam or unlawful content through the messaging features; attempting to access accounts or data that are not yours; reverse-engineering, disrupting or overloading the Service; or using it to breach any worker's rights.
5. WhatsApp messaging
The Service can deliver documents, notices and messages to workers via the WhatsApp Business Platform, and receive their replies and acknowledgements. You must have each worker's consent before sending. Message delivery depends on WhatsApp and Meta and on the worker's number and device; we cannot guarantee delivery or timing. Your and your workers' use of WhatsApp is also subject to WhatsApp's own terms.
6. Subscriptions and billing
Adding and setting up workers is free. Certain features are provided on a paid subscription basis, with pricing based on the number of workers, shown in the app before you subscribe. Subscriptions are billed through the Apple App Store and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel your subscription in your App Store account settings. Except where required by law or by Apple's policies, payments are non-refundable.
7. Intellectual property
The Service, including its software, design, text and branding, is owned by KhayaPay and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own household's payroll and compliance. You retain ownership of the data you enter.
8. Your data and documents
Documents issued through the Service (such as payslips and notices) are designed to be immutable once created, to preserve an accurate record. You may export or delete your data as provided in the app. Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
9. Availability and disclaimers
We work to keep KhayaPay accurate and available, but the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that calculations or documents will meet every requirement of your particular circumstances.
10. Limitation of liability
To the extent permitted by law, KhayaPay will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data or goodwill, arising from or relating to your use of the Service. Nothing in these Terms limits liability that cannot be limited under South African law, including under the Consumer Protection Act where it applies.
11. Indemnity
You agree to indemnify and hold KhayaPay harmless from claims, losses and expenses arising from your breach of these Terms, your misuse of the Service, or your failure to meet your legal obligations as an employer or to obtain the consents required from your workers.
12. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or use the Service unlawfully, or as needed to protect the Service or other users. Provisions that by their nature should survive termination (including sections 7, 10 and 11) will survive.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa. You agree to the jurisdiction of the South African courts. We will try to resolve any dispute with you informally first — please contact us before taking any other step.
14. Changes to these Terms
We may update these Terms from time to time. We will change the "last updated" date above and, where changes are significant, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
